A First Amendment win for concerned citizens.

After nearly two years of litigation, JT Morris Law helped a group of citizens favorably settle a First Amendment lawsuit against the City of Cibolo and several of its elected officials.

The lawsuit centered on allegations that these officials and the City abused their power to intimidate silence their critics, including the citizens JT Morris Law represented in the lawsuit. A focal point of the lawsuit was the City’s policy for moderating citizen comments at city council meetings. In particular, the lawsuit alleged the policy was unconstitutional because it allowed officials to silence commenters based on viewpoint. The lawsuit also alleged acts of retaliation against the citizens for speaking out, including false arrest reports and blocking the citizens from various social media pages.

The citizens defeated the City’s motion to dismiss. Then, after much discovery, the parties settled. Above all, the City agreed to change its citizen comment policy to make it viewpoint neutral and better defined. It also agreed not to block citizens from official social media pages. And it paid the citizens a significant financial settlement.

The case is a good example of how citizens standing up to local government can help ensure free speech protections for themselves and their fellow citizens.
